Delayed enforcement of mandatory AES filing requirement

According to sources, enforcement of the requirement for export data to be filed through the Automated Export System is being delayed. The mandatory AES regulations took effect Oct. 1, but U.S. Customs and Border Protection says it will continue its informed compliance period for the rules until it can issue guidelines on the mitigation of penalties for noncompliance. Those policies are expected in the next few weeks and will be published in the Customs Bulletin and Decisions. Census Bureau officials said last week that pending full enforcement of the AES rules they may refer suspected violations to the Commerce Department’s Office of Export Enforcement if warranted. Both CBP and OEE are responsible for enforcing the AES regulations.
